1) About us
Shokall Property (“we”, “us”, “our”) provides estate agency services including sales, lettings and property management in the UK.
2) Definitions
- Client: a person or company instructing us (e.g., seller, landlord).
- Applicant: prospective buyer or tenant.
- Property: real estate marketed or managed by us.
- Agreement: a signed contract or written instruction for services.
3) Using our website
- You must not misuse the site (e.g., introduce malware, scrape without consent, or attempt unauthorised access).
- Content is for general information only and may change without notice.
- We may suspend or withdraw the site without liability.
4) Our services
Scope and fees are set out in your signed instruction or service Agreement. We act as agent between our Client and Applicants. We may partner with third-party suppliers where needed (e.g., referencing, photographers).
5) Valuations & marketing content
- Valuations are opinions based on market evidence and are not guarantees.
- Floor plans, photos, measurements and descriptions are for guidance only; Applicants must verify critical details.
6) Viewings, offers & sales progression
- We will present offers to the Client promptly and fairly.
- All agreed sales remain “subject to contract” until exchange of contracts.
- Buyers should obtain independent surveys, legal and financial advice.
7) Lettings & management
- Tenancies are granted subject to satisfactory references and landlord approval.
- Deposits are handled in accordance with applicable deposit protection rules.
- Unless we are instructed for full management, landlords remain responsible for safety compliance, repairs and statutory obligations.
8) Fees & payment
- Our commission/fees are set out in the Agreement and become payable on the relevant trigger (e.g., exchange/completion, tenancy start).
- Invoices are due on receipt unless otherwise agreed. We may deduct fees from client monies held.
- Late payments may accrue interest and recovery costs as permitted by law.
9) Referencing, AML & Right to Rent
- We may require identity/address verification and source-of-funds checks to comply with AML/KYC obligations.
- Tenants must satisfy Right to Rent checks where applicable.
- We may use external agencies to perform these checks on our behalf.
10) Liability & disclaimers
We do not exclude liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we exclude all implied warranties to the fullest extent permitted and are not liable for indirect or consequential loss. Our total liability is limited to the amount of fees paid for the service giving rise to the claim (unless otherwise required by law).
11) Cancellation & cooling-off
If you are a consumer and you entered into an off-premises or distance Agreement with us, you may have a statutory cooling-off period. If you ask us to start work during this period, you may be charged proportionately for services provided before cancellation.
12) Term & termination
Either party may terminate in accordance with the Agreement’s notice provisions. Any accrued fees/expenses and surviving clauses remain payable/enforceable after termination.
13) Intellectual property
Website content (text, images, branding, code) is owned by or licensed to us and protected by IP laws. You may not copy, distribute or create derivative works without permission.
14) Data protection & privacy
Your personal data is handled under our Privacy Policy. By using our site or services, you acknowledge that you have read it.
15) Cookies & tracking
We use cookies/analytics as described in our Cookie Policy. Manage your preferences via our cookie banner or settings page.
16) Third-party sites & tools
Our site may link to external websites or embed third-party tools. We are not responsible for their content or practices.
17) Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control (e.g., government action, cyber incidents, utility failures, extreme weather).
18) Changes to these Terms
We may update these Terms from time to time. The current version is posted here with the “Last updated” date.
19) Governing law & jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute.
